Welcome to Rhonda Smith Watercolors. By accessing or purchasing from this website (rhondasmithwatercolors.com), you agree to be bound by the following terms and conditions. Please read them carefully before making a purchase.

1. Intellectual Property

All artwork, images, designs, and content on this website are the exclusive intellectual property of Rhonda Smith Watercolors and are protected by U.S. and international copyright laws. You may not reproduce, distribute, display, sell, or create derivative works from any artwork or content without prior written permission from Rhonda Smith.

Purchase of a print or original painting does not transfer copyright or reproduction rights to the buyer.

2. Original Paintings

Each original watercolor painting is a one-of-a-kind work of art. Colors may vary slightly from screen to screen due to monitor calibration differences. All sales of original paintings are final unless the item arrives damaged (see Section 5).

3. Prints

Prints are reproductions of original artwork. Every effort is made to ensure accurate color representation, but slight variations may occur. Print sizes and paper types are described in each product listing.

4. Commissions

Commission orders (including portraits and pet portraits) require a non-refundable 50% deposit at the time of booking. The deposit covers initial design work and reserves your spot in the commission queue. The remaining balance is due upon completion and before the final artwork is shipped. Commissions are non-refundable once work has begun, except in cases of artist error.

A digital proof will be provided for your review before the final piece is shipped. You will have one opportunity to request minor revisions. Major changes to the original brief may incur additional fees.

5. Damaged or Lost Shipments

If your order arrives damaged, please contact me within 7 days of delivery at rhondasmithwatercolors@yahoo.com with your order number and photos of the damage. I will work with you to arrange a replacement or refund where applicable.

We are not responsible for packages lost or delayed due to carrier error, incorrect shipping addresses provided at checkout, or circumstances beyond our control (e.g., weather, customs delays).

6. Returns & Refunds

Due to the handmade and one-of-a-kind nature of our products, all sales are final except in the case of damaged goods. If you have concerns about your order, please reach out and we will do our best to make it right.

7. Pricing

All prices are listed in U.S. dollars. We reserve the right to change prices at any time without notice. Prices in effect at the time of your order will apply to that order.

8. Limitation of Liability

Rhonda Smith Watercolors shall not be liable for any indirect, incidental, or consequential damages arising from the use of this website or the purchase of products. Our total liability to you for any claim shall not exceed the amount you paid for the product in question.

9. Governing Law

These terms are governed by the laws of the United States and the state in which Rhonda Smith Watercolors operates. Any disputes shall be resolved in the applicable courts of that jurisdiction.

10. Changes to These Terms

I reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of the website after changes are posted constitutes your acceptance of the revised terms.

12. Print-on-Demand Products (Printify)

Some products in this store — including select prints and merchandise — are produced and fulfilled by Printify, a third-party print-on-demand service. The following terms apply to these items:

Shipping: Printify orders are produced and shipped separately from original paintings and handmade items. Production typically takes 2–7 business days, with shipping times varying by destination and carrier. Estimated delivery times are provided at checkout but are not guaranteed.

Returns & Exchanges: Printify-fulfilled products are made to order and are therefore non-refundable and non-exchangeable unless the item arrives defective, damaged, or incorrect. If you receive a defective or wrong item, please contact me within 7 days of delivery at rhondasmithwatercolors@yahoo.com with your order number and photos. I will work with Printify to arrange a replacement at no additional cost to you.

Order Cancellations: Because Printify orders go into production quickly, cancellations must be requested within 24 hours of placing your order. After that window, cancellations may not be possible.

Lost Shipments: If your Printify order is lost in transit, please contact me and I will file a claim with Printify on your behalf. Rhonda Smith Watercolors is not liable for carrier delays or losses but will do everything possible to resolve the issue.
